Privacy Policy
What personal information Crimson Spark Agency collects, why we collect it, who processes it, and the rights you have over it.
1. Who we are
Crimson Spark Agency ("Crimson Spark", "we", "us") is a creative production and consulting business based in Greater Montreal (Terrebonne), Quebec, Canada. We produce AI-generated film and video content, deliver AI workflow consulting and workshops, and sell self-serve digital products.
Because we are established in Quebec, this policy is written to meet the requirements of Quebec's Act respecting the protection of personal information in the private sector, as amended by Law 25, and Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).
Person responsible for the protection of personal information: Gabriel Brien, Founder, Crimson Spark Agency. Reach this role at hello@crimsonsparkagency.com.
2. What we collect
Information you give us directly
When you submit one of the forms on this site (the contact form, the fit quiz, or the early-access form) we receive what you type into it. Depending on the form, that can include your name, email address, company or business name, and whatever you describe about your project, timeline or budget range. You choose what to put in those fields.
If you book a call with us, the booking is handled by Cal.com and we receive the name, email address and any notes you provide when booking.
Information collected automatically
Like most websites, this site records technical information when you visit: IP address, browser and device type, the pages you view, how you arrived, and how long you stay. This is collected through Google Analytics 4, loaded via Google Tag Manager, using cookies and similar technologies.
We use this to understand which pages are useful and where visitors drop off. We do not use it to build advertising profiles, and we do not sell it.
Payment information
We do not collect, see or store your payment card details. Purchases of our digital products are processed entirely by Payhip and its payment providers. We receive confirmation that a sale occurred, along with the buyer's email address, so we can deliver the product and provide support. Payhip's handling of your payment data is governed by Payhip's own privacy policy.
3. Why we use it
- To answer your inquiry and follow up about a project you asked us about.
- To deliver a product or service you purchased, and to provide support for it.
- To schedule and prepare for calls you book with us.
- To understand how the site is used, so we can improve it.
- To send you information you explicitly asked to receive, such as early access to a release. You can withdraw that consent at any time.
- To meet our legal, accounting and tax obligations.
We do not use your personal information for purposes unrelated to the ones above without asking you first.
4. Who processes it
We use a small number of third-party providers to run this business. Each one only receives what it needs to perform its function:
- Netlify: hosts this website and receives the submissions from our contact, quiz and early-access forms.
- Google (Analytics 4 and Tag Manager): provides the site usage statistics described above.
- Payhip: processes purchases of our digital products and handles payment information directly.
- Cal.com: handles call scheduling.
- HubSpot: stores the contact details and conversation history of people who have written to us or become clients, so we can follow up on their request.
We do not sell personal information, and we do not share it with anyone other than the providers above, except where we are legally required to do so.
5. Information stored outside Quebec
The providers listed above are established outside Quebec, primarily in the United States. This means that personal information you give us may be stored and processed outside the province, where it is subject to the laws of the country in which it is held, including lawful access by authorities in that country.
We rely on the contractual and security commitments each provider publishes for its own service. If you would prefer not to have your information handled on this basis, do not submit it through the forms on this site: email us directly instead and tell us what you need.
6. How long we keep it
We keep personal information only for as long as it serves the purpose it was collected for, or as long as we are required to keep it for legal, tax or accounting reasons, after which it is deleted or anonymized. Inquiry and form data that never turns into a project or a purchase is not kept indefinitely.
7. Your rights
Under Quebec law, you have the right to:
- Access the personal information we hold about you.
- Correct information that is inaccurate, incomplete or out of date.
- Withdraw your consent to a use you previously agreed to, including email communication.
- Request deletion of information we no longer have a legitimate reason to keep.
- Be informed of the reasons behind any decision made about you based solely on automated processing of your personal information, if one is ever made. We do not currently make such decisions.
To exercise any of these, write to hello@crimsonsparkagency.com. We will respond within the timeframe required by law, normally within 30 days. We may need to verify your identity before acting on a request.
If you are not satisfied with how we handle your request, you may file a complaint with the Commission d'accès à l'information du Québec.
8. Cookies
This site uses cookies for analytics, as described in section 2. Most browsers let you refuse cookies or delete ones already stored, through your browser settings. Refusing analytics cookies does not prevent you from using this site: the pages, forms and purchases all work without them.
9. Security
We take reasonable measures to protect the personal information in our care, including limiting who can access it and relying on established providers for hosting, payments and email. No method of transmitting or storing information is completely secure, and we cannot guarantee absolute security. If a confidentiality incident occurs that presents a risk of serious injury, we will notify the affected individuals and the Commission d'accès à l'information du Québec as required by law.
10. Children
This site and our services are directed at businesses and professionals, not children. We do not knowingly collect personal information from anyone under the age of 14. If you believe a child has submitted information to us, contact us and we will delete it.
11. Changes to this policy
We may update this policy as our business, tools or legal obligations change. The "last updated" date at the top of this page always reflects the current version. Material changes will be reflected on this page before they take effect.
12. Contact
Questions about this policy, or about personal information we hold, go to hello@crimsonsparkagency.com, attention: Gabriel Brien, person responsible for the protection of personal information.
